According to the Commission chaired by the Democratic Revolutionary Party (PRD), deputy  Roberto Ábrego, this State Organ no longer has powers to investigate Varela and De Saint Malo.

According to the Political Constitution of Panama, the President and Vice President are investigated by the National Assembly, however, once they leave office they go to the regular justice system.

In the case of former President Ricardo Martinelli, who faced a process for illegal wiretapping during his administration, he was investigated by the Supreme Court at the beginning of the investigations, because he was a deputy of the Central American Parliament (Parlacen).
