THE INVESTIGATION of Panama law firm Mossack Fonseca by  The Second Specialized Prosecutor against Organized Crime will resume with the return of the 34 volume file on the Panama Papers.

Supreme Court Justice Oydén Ortega, rapporteur in an action for protection of constitutional guarantees in the process, agreed to return the original file to the prosecution to continue with the investigations.

The investigation was suspended in  January due to an appeal by the defenders of the firm's partners, Ramón Fonseca Mora and Jürgen Mossack, against a decision of the First Superior Court of Justice that denied them a protection claim.

In order for Ortega to continue the analysis of the file and resolve the action against the appeal, the prosecution will send the magistrate authenticated copies of the file.

Background

The investigation began on April 5, 2016 following the worldwide scandal of alleged use of offshore companies, allegedly created by the firm, to hide the fortunes of politicians, businessmen sport personalities and potentially organized crime leaders.

On September 28, 2016, after completing the ordinary term for finishing  the investigation, the prosecution asked the Seventeenth Circuit Criminal Court of Panama, for an extended  period until to complete  the investigative process.

On October 12, 2016, the court under  of Baloísa Marquínez, accepted the request.

Subsequently, the defense of the law  firm appealed, through an amparo of constitutional guarantees, before the First Superior Court of Justice, which also declared the appeal unfounded.

Then, the firm appealed  the rejection of the appeal to the Supreme Court  and pending before Judge Ortega. is  an alleged money-laundering offense.
